   Whereas the office of the President of the Public Service Commission will become vacant, effective May 21, 2011;

 

   Whereas, pursuant to subsection 4(5) of the Public Service Employment Act, the Senate and the House of Commons will not have the opportunity to approve by resolution the appointment of a President of the Public Service Commission before the office becomes vacant on May 21, 2011;

 

   And whereas, subsection 6(3) of the Public Service Employment Act, provides that if the office of President is vacant, the Governor in Council may authorize a Commissioner or other qualified person to act as President for a period exceeding sixty days;

 

   Therefore, His Excellency the Governor General in Council, on the recommendation of the Prime Minister, hereby:

 

 (a)  pursuant to subsection 6(3) of the Public Service Employment Act, authorizes Maria Barrados of Ottawa, Ontario, to act as President of the Public Service Commission until December 31, 2011, or until such time as a President is appointed, whichever is earlier; and

 

 (b)  fixes her salary to be equal to that of a judge of the Federal Court, as amended from time to time;

 

effective May 21, 2011.


   Attendu que le poste de président de la Commission de la fonction publique sera vacant à compter du 21 mai 2011;

 

   Attendu qu’en vertu du paragraphe 4(5) de la Loi sur l’emploi dans la fonction publique, le Sénat et la Chambre des communes n’auront pas la chance d’approuver par résolution la nomination d’un président de la Commission de la fonction publique avant que le poste ne devienne vacant le 21 mai 2011;

 

   Attendu qu’en vertu du paragraphe 6(3) de la Loi sur l’emploi dans la fonction publique, le gouverneur en conseil peut autoriser, pendant la vacance du poste de président, un commissaire ou une autre personne qualifiée à assumer la présidence pour une période excédant soixante jours;

 

   À ces causes, sur recommandation du premier ministre, Son Excellence le Gouverneur général en conseil :

 

 a)  en vertu du paragraphe 6(3) de la Loi sur l’emploi dans la fonction publique, autorise Maria Barrados, d’Ottawa (Ontario), à assumer la présidence de la Commission de la fonction publique jusqu’au 31 décembre 2011, ou jusqu’à ce qu’un président soit nommé, selon la première de ces éventualités;

 

 b)  fixe son traitement lequel sera l’équivalent de celui d’un juge de la Cour fédérale, modifié de temps à autre;

 

à compter du 21 mai 2011.
